In the statement, the US Department of Justice contended that the lawsuit “endangers American national, economic, and energy security by attempting to cut off the power supply for artificial intelligence advancements that assist the Department of War’s military activities.”
To back the claim, federal prosecutors provided testimony from Pentagon AI leader Cameron Stanley, who stated under oath that Grok is currently being utilized in Project Maven, the US military’s AI-driven targeting initiative that was originally supported by Anthropic’s Claude model.
According to Stanley’s statement, the project’s Maven Smart Systems (MSS) “allowed US forces to send more than 2,000 munitions to 2,000 separate targets within 96 hours during Operation Epic Fury.”

Stanley commended Elon Musk innovation and “the significantly enhanced operational effectiveness enabled by the Grok Gov Model.”
The NAACP, a civil rights group advocating for Black Americans’ rights, is suing xAI, claiming it is running numerous turbines without permits, violating the Clean Air Act.

The rights organization asserts that they contaminate predominantly Black communities, while xAI claims the turbines are transient and portable, thus exempt from regulation.
In late February, the government ended its agreements with Anthropic after the company declined to permit its tools for fully automated attacks or the extensive surveillance of Americans.
The Pentagon subsequently sought out Anthropic’s rivals, including Google, OpenAI, and xAI, to advance its AI efforts.
